The St. Mary Parish Council met on this date in Regular Session with Chairman Steve Bierhorst presiding and the following members present: Lionel Metz, Charles Middleton, Glen Hidalgo, Ken Singleton, Logan Fromenthal, Tim Tregle, Sterling Fryou, Albert Foulcard and Kevin Voisin. Absent was David Hanagriff.

Mr. Voisin pronounced the Invocation and Mr. Foulcard led the Pledge of Allegiance.

Mr. Voisin moved that the reading of the minutes of the First Regular Meeting, May 14, 2014 be dispensed with and that the same be approved. Mr. Fryou seconded the motion, which carried.

Mr. Naquin, Parish President did not have any information to report at this time.

Henry LaGrange, Chief Administrative Officer presented his report for a two (2) week period ending May 28, 2014. (All items in Mr. LaGrange’s report are informational.)

Mr. LaGrange informed that an ordinance declaring certain Public Property surplus and authorizing the
sale of same has been presented for consideration of introduction to the Council.

Mr. Voisin thanked the Administration and the Public Works department for installing signage at the various boat ramps in the Parish.

BE IT ORDAINED by the St. Mary Parish Council, State of Louisiana, in regular session convened on this the ______ day of June 2014:

SECTION I. The intersection of Southeast Boulevard and Delmar Avenue shall be designated as a "four way stop" intersection, and signs designating such shall be erected and posted.

SECTION II. All vehicles approaching said intersection shall stop thereat and yield the right-of-way as provided by the laws of the State of Louisiana.

SECTION III. Violation of the provisions hereof shall be punished by imprisonment in the Parish jail of not more than thirty days or fine of not more than $100.00, or both.

SECTION IV. Should any Section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction for any reason, the remainder of said Ordinance shall not be affected thereby and shall remain in full force and effect.

SECTION V. All ordinances or parts thereof, in conflict herewith shall and they are hereby repealed.

AN ORDINANCE TO AMEND SECTION 8-2, “PRECINCTS DESIGNATED”,
OF THE ST. MARY PARISH CODE OF ORDINANCES.

WHEREAS, the St. Mary Parish Government developed a new election plan for the members of the St. Mary Parish Council that was in fulfillment of the requirements of the U.S. Department of Justice under Section 5 of the Voting Rights Act, the requirements of the State of Louisiana and the Louisiana Secretary of State, and:

WHEREAS, the St. Mary Parish School Board developed a new election plan for the members of the St. Mary Parish School Board that was in fulfillment of the requirements of the U.S. Department of Justice under Section 5 of the Voting Rights Act, the requirements of the State of Louisiana and the Louisiana Secretary of State, and:

WHEREAS, the precinct splits contained in the Reapportionment Plans meet the requirements for splitting precincts as promulgated by the State of Louisiana such as but not limited to using census tabulation blocks that contain visible features for split precinct boundaries;

WHEREAS, La. R.S. 18:532B(4)(b)(ii) requires that no precincts shall contain less than 300 registered active voters, and:

WHEREAS, Adjacent Precincts being 05 and 06, 06A and 07, 40 and 45 can be merged into one precinct respectfully, and:

WHEREAS, Adjacent Precincts of 40 and 41A can be merged and redescribed respectfully, and:

NOW, THEREFORE BE IT RESOLVED by the St. Mary Parish Council, in regular session assembled, that the following precincts are amended in their descriptions and consolidated new whole precincts or redescribed to comply with La. R.S. 18:532B(4)(b)(ii) which descriptions and polling locations are hereby to wit:

New Precinct 6 – A merging of old Precinct 5 and old Precinct 6

An Ordinance levying and imposing a tax of 5.72 mills for the purpose of maintaining and supporting the St. Mary Parish Public Library and its
branches as directed by a special election held April 30, 2011 in the Parish
of St. Mary, excluding the municipality of Morgan City, for the year 2014;
and levying and imposing a one and twenty-five hundredths (1.25) mills
tax on all the property subject to taxation in the Parish of St. Mary, State of Louisiana, excluding the City of Morgan City, for the year 2014.

BE IT ORDAINED, by the St. Mary Parish Council of the Parish of St. Mary, Louisiana, in a public hearing held on May 28, 2014, which hearing was conducted in accordance with the open meetings law and the additional requirements of Article VII, Section 23(C) of the Constitution, that the taxing authority voted to adopt and impose the following millage rate(s), on all taxable property shown on the official assessment roll for the year 2014, and when collected, the revenues from said taxes shall be used only for the specific purposes for which said taxes have been levied. Mr. Metz moved that Olivia Sue Patrick be reappointed to Recreation District No. 5 Board of Commissioners. Mr. Middleton seconded the motion, which carried.

D. Kevin Ardoin, Laboratory Director, Acadiana Criminalistics Laboratory has written to update you on the Acadiana Legislative Delegation to secure annual state funding for the Acadiana Crime Lab in the current Legislative session.

Attached is a letter by Senator Jonathon Perry on behalf of the Acadiana Legislative Delegation to the Office of Governor Bobby Jindal. In addition to requesting state funds, the letter also requests a meeting with the Governor’s office.

As stated in in the email dated March 31st, the Acadiana Crime Lab budget will be fully depleted by the beginning of budget year 2015.

I strongly urge each and every member of the Acadiana Criminalistics Laboratory Commission to reach out to their respective Acadiana Legislative Delegates in hopes of meeting with the Office of Governor Bobby Jindal, and ultimately receiving the funds needed to maintain the same level of crime laboratory services for the Acadiana area. Without these funds, the crime lab may be forced to make cuts in needed services and personnel.

Mr. Hiro Alexandrian, Area Engineer, Department of Transportation and Development has written acknowledging receipt of the Resolution dated April 23, 2014, requesting a speed limit evaluation along LA Highway 182 near Patterson High School from the western city limits of the City of Patterson to Hemlock Drive, St. Mary Parish.

Our Traffic Section will investigate this request after which time we will advise you of our findings and recommendation.

G. Mr. Hiro Alexandrian, Area Engineer, Department of Transportation and Development has written acknowledging receipt of the Resolution dated April 23, 2014, requesting a speed limit evaluation along LA Highway 182 from the St. Mary Centerville Bridge east to the Presbyterian Church located at 9089 Hwy. 182 and during school hours when school is in session and to construct a crosswalk at Centerville Fire Station across Hwy. 182 to the Centerville Branch Library, St. Mary Parish.

Our Traffic Section will investigate this request after which time we will advise you of our findings and recommendation.

H. Lisa Shilling, Executive Director, South Central Louisiana Human Services Authority has written to request assistance in the selection of a new Board Member for the South Central Louisiana Human Services Authority (SCLHSA). Effective May 1, 2014, Mr. Lars Levy resigned his board position as the appointed St. Mary Parish Board Member.

Your assistance beginning the process to fill the vacancy and appoint a new individual to serve a three year term on the Board of Directors for the SCLHSA would be greatly appreciated.

I. Mr. Hidalgo to request a reallocation of $10,000 from Wards 5 & 8 3/10% Sales Tax Fund to the Fire District No. 7 for improvements to the interior of the Saturn Street Fire Station.

Mr. Hidalgo moved that funds in the amount of $10,000 be reallocated from Wards 5 & 8 3/10% Sales Tax Fund to Fire District No. 7 for improvements to the interior of the Saturn Street Fire Station. Mr. Singleton seconded the motion, which carried.

This rate does not extend to fee-paid advertising which is a notice placed by a government entity but billed to a third party. Fee paid advertising rates are set by separate fee-paid advertising legislation.

Mr. Voisin moved that the offer from Allan Von Werder, Banner-Tribune for the 12-month period of July 1, 2014 to June 30, 2015 to publish the entire Parish’s minutes, public notices, ordinances, etc. at the rate of $6.00 per square which equals $3.00 per column inch be accepted. Mr. Fromenthal seconded the motion, which carried.

C. Becky Soprano, Office Administrator, St. Mary Parish Waterworks District No. 5 has written that St. Mary Parish Waterworks District No. 5 have discussed of a project to add an additional 10” main waterline on the south side of Highway 90, south of the Hwy. 90 Frontage Road, near the intersection of Highway 317, for a distance of approximately 1460’, going westerly toward the Law Enforcement Center and joining with the existing water main there. This extension line would create a loop in our water system that will allow the District to isolate areas for repair without interruption of water service to the Law Enforcement Center.

We have secured quotes to accomplish this project, with the lowest quote at $53,891.

We are requesting from the Parish for participation in this project the amount of $20,000.

Mr. Hidalgo moved that funds in the amount of $20,000 be allocated Waterworks District No. 5 to assist with the project to add an additional 10” main waterline on the south side of Highway 90, south of the Hwy. 90 Frontage Road, near the intersection of Highway 317, for a distance of approximately 1460’, going westerly toward the Law Enforcement Center and joining with the existing water main. Mr. Voisin seconded the motion, which carried.

In response to an inquiry by Mr. Hidalgo, Mr. LaGrange explained that the funds will be allocated from the Jail Construction Fund, Fund 323.

D. Mr. Hanagriff to request an allocation of $10,000 from Wards 1, 2, 3, 4, 7 & 10 3/10% Sales Tax Fund for painting of the Grevemberg House Museum.

Mr. Voisin moved that funds in the amount of $10,000 be allocated from $10,000 from Wards 1, 2, 3, 4, 7 & 10 3/10% Sales Tax Fund for painting of the Grevemberg House Museum. Mr. Singleton seconded the motion, which carried.

There being no further business, Dr. Tregle moved for adjournment. Mr. Fryou seconded the motion,
which carried.
